Agreement to terms

By accessing or using our websites (isfeindy.com and shop.isfeindy.com), placing an order through our online ordering platform, or engaging our catering services, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use our services.

About us

Illinois Street Food Emporium ("ISFE," "we," "us," or "our") is a scratch kitchen and bakery café located at 5550 N Illinois St, Indianapolis, IN 46208. We have served the Indianapolis community since 1979. We operate a dine-in and takeout restaurant, a catering service, a wholesale operation, and a nationwide cookie e-commerce store.

Website use

Our websites are provided for informational purposes and to facilitate ordering. You agree to use our websites only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the sites.

We make reasonable efforts to keep menu items, pricing, and availability accurate across our websites. However, menus, prices, and availability are subject to change without notice. In the event of a pricing error, we reserve the right to cancel or refuse any order placed at an incorrect price.

Cookie e-commerce orders (shop.isfeindy.com)

Placing an order

All cookie orders placed through shop.isfeindy.com are subject to availability. Current pricing, product details, and shipping costs are listed on the product pages at the time of purchase. We reserve the right to limit order quantities or refuse any order at our discretion. An order confirmation email does not guarantee fulfillment if an error in pricing or availability is discovered after the order is placed.

Pricing and promotions

All prices are listed in U.S. dollars and are displayed on the relevant product pages at the time of purchase. Prices, shipping rates, and promotional offers (including free shipping thresholds) are subject to change at any time without notice. Promotional discounts may be modified or discontinued at our discretion.

Payment

All cookie e-commerce orders must be paid in full at the time of purchase. We accept the payment methods listed at checkout. Payment is processed securely through Shopify's payment system.

Shipping and delivery

Our cookies are perishable, handmade products shipped from Indianapolis, Indiana. We ship nationwide using carriers experienced with perishable goods. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control.

Once your order has shipped, you will receive a tracking number by email. Risk of loss and title for items pass to you upon delivery to the carrier.

Perishable product notice

Our cookies are made from scratch with no preservatives. They are best enjoyed within the timeframe noted on the packaging or product listing. We are not responsible for product quality after the recommended consumption window or if cookies are not stored as directed.

Order modifications and cancellations

Because our cookies are baked to order, we may not be able to accommodate changes or cancellations once an order has entered production. If you need to modify or cancel an order, please contact us as soon as possible at leyla@isfeindy.com or 317-253-9513. We will do our best to accommodate your request but cannot guarantee changes once production has begun.

Returns and refunds

Due to the perishable nature of our products, we do not accept returns. If your order arrives damaged, with missing items, or significantly different from what was described, please contact us within 48 hours of delivery at leyla@isfeindy.com with photos of the issue. We will work with you to resolve the problem, which may include a replacement shipment or a refund at our discretion.

Refunds, when issued, will be processed to the original payment method. Please allow 5 to 10 business days for the refund to appear on your statement.

We do not issue refunds for orders that have been successfully delivered but are not retrieved in a timely manner, or for quality issues resulting from improper storage after delivery.

Online ordering (Toast)

Online orders for dine-in pickup or takeout are placed through our Toast ordering platform. These orders are subject to Toast's terms of service in addition to our own. Menu items, pricing, and availability shown on the Toast platform reflect our current in-store offerings but may vary. We reserve the right to cancel any online order due to availability, pricing errors, or operational constraints.

Catering

Ordering

Catering orders are appreciated as far in advance as possible. A minimum of 24 hours notice is required for all catering orders. All menu changes require 48 hours notice. Minimum guest counts apply and are noted on our catering menu.

Delivery

A minimum order amount is required for catering delivery. A delivery fee applies to all delivered orders. Additional fees may apply for orders above a certain total, locations outside Marion County, deliveries after 4:00 PM, deliveries outside normal business hours, or special requests. Current minimums and fees are listed on our catering menu or available by contacting us directly.

Payment

All catering orders must be paid in full prior to pickup or delivery unless special arrangements have been made in advance.

Equipment

Basic equipment rental and disposable service items (chafers, plates, silverware, napkins, cups, and serving utensils) are available for an additional charge. Equipment and disposable pricing is provided at the time of your catering quote.

Cancellation

Cancellation must be received in writing by 10:00 AM one business day prior to the scheduled delivery or pickup. Orders cancelled less than 24 hours in advance will be charged in full (100%).

Allergens and dietary information

ISFE operates a scratch kitchen that handles common allergens including but not limited to wheat, dairy, eggs, tree nuts, peanuts, soy, and shellfish. All items are prepared in a shared kitchen environment. While we offer gluten-free and other dietary options, we cannot guarantee that any item is completely free from allergens or cross-contact.

Customers with food allergies or dietary restrictions should speak with a manager before ordering. Menu descriptions identify certain dietary attributes where applicable, but we encourage direct communication for specific concerns.

We are not liable for allergic reactions or adverse health effects resulting from the consumption of our products, particularly when allergen information was available and cross-contact risks were disclosed.

Intellectual property

All content on our websites, including text, images, logos, graphics, and design elements, is the property of Illinois Street Food Emporium or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our websites without our prior written consent.

The name "Illinois Street Food Emporium," our logo, and related marks are trademarks of Illinois Street Food Emporium. Use of our trademarks without authorization is prohibited.

User content

If you submit content to us through social media, reviews, email, or other channels (such as photos, testimonials, or feedback), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including on our websites and social media accounts. We will not use your content in a way that misrepresents your intent.

Third-party links and services

Our websites may contain links to third-party websites and services, including our online ordering platform, social media accounts, and payment processors. We are not responsible for the content, privacy practices, or terms of service of any third-party sites. Your use of third-party services is governed by their respective terms.

Limitation of liability

To the fullest extent permitted by applicable law, Illinois Street Food Emporium, its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our websites, products, or services. This includes but is not limited to damages related to errors in menu or pricing information, shipping delays, product quality after delivery, or interruptions to our websites or ordering platforms.

Our total liability for any claim arising from or related to our products or services shall not exceed the total amount you paid for the specific order giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Illinois Street Food Emporium, its owners, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our websites or services, your violation of these terms, or your violation of any rights of a third party.

Governing law

These terms and conditions are governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be resolved in the state or federal courts located in Marion County, Indiana.

Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

We may update these terms and conditions from time to time. When we do, we will update the "last updated" date at the top of this page. Continued use of our websites or services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
